According to the U.S. Patent and Trademark Office, "a trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others. A service mark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of a service rather than goods. [...] The term trademark is often used in a general sense to refer to both trademarks and service marks."
Trademarks such as “BOT” and other marks related to Black Oak Training that are indicated on our site refer exclusively to Black Oak Training, Inc., a firearms training company in Magalia CA. The use of any trademarks and trade dress is prohibited if used in connection with the sale of any product that is not BOT's, in any manner that seeks to disparages or discredit BOT or in any manner that may cause confusion among our customers.
All BOT-related content on this website is the exclusive property of Black Oak Training. Said content includes text, graphics, logos, icons, images, audio and video clips, digital downloads, and software. Our content is protected by United States and international copyright laws and we reserve all rights contained therein. In case of dispute or infringement, we will rigorously defend our rights to this material.
License and Site Access
Black Oak Training, Inc. grants you (the user) a limited license to access and make personal use of this website. This license does not include the right to download any material (other than routine page caching), modify any material, or any portion thereof, without the express written consent of Black Oak Training, Inc. This license excludes the download or collection of logos, product descriptions, pricing, text, graphics, audio and video clips, and/or copying account information. Black Oak Training, Inc. makes no warranties, either expressed or implied, as to the operation of the site or the content contained therein. Black Oak Training, Inc. will not be responsible for any damages of any kind resulting from use of this website, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
Cancellations and Refunds
Please review this Cancellation/Refund policy. We believe it's fair to you, to other students, and to us.
The only way we can know if a class is full is that the specified number of students have registered and paid their instructor fees. When class IS full, we have to turn away others who would have liked to attend. If you cancel too close to class, or fail to show up for class, you keep someone else from attending (and, frankly, you cost us a student). Therefore:
- Be sure you can attend a class before signing up for it.
- Once your space in a regular BOT class has been scheduled and paid for, there are no refunds. If you reschedule at least 72 hours before the class, there is no charge for rescheduling. However, if you reschedule less than 72 hours before class time, there is a $30.00 rescheduling fee.
- Occasionally we offer training with guest instructors. In those cases, once your space has been scheduled and paid for there are no refunds less than 30 days before class date.
- In some cases we may specify in the class description that we will accept 50% deposits on a space in class. If you put down a deposit to hold your space, the balance is due in full 21 calendar days prior to the date of class.
Specific to CCW classes: As described on our Initial CCW and CCW Renewal class pages, obtaining a new or renewed CCW requires approval from the Sheriff of your county of residence. Now and then, due to student scheduling needs, we've included a student in a CCW class prior to that student's actual receipt of approval. This is not recommended. Should permission subsequently be denied, we do not refund the cost of class. (In other words, be sure your approval is either in hand or about to arrive before your CCW class.)
Redemption of free and coupon offers
From time to time BOT may offer its members special offers and discount codes to be used in conjunction with this website. These offers are frequently disseminated via this website and through email to those who are registered on our email list, or announced via other means of communication in conjunction with the promotion of BOT products, including radio and TV broadcasts, internet forums, and various online websites.
We encourage customers to redeem these special offers, but we respectfully ask that you not exploit them. BOT, at our sole discretion, will determine whether all criteria have been met to qualify for stated discount or free product. If you successfully circumvent the software safeguards of this website in order to receive several free products with your purchase, we will (at our sole discretion) remove any extraneous free product from your order or cancel the order in its entirety. You will be informed of any order changes via the phone number or email address listed with your order. Please, play fair.
Redemption of donated classes
Occasionally we donate a class to a nonprofit organization for use in their fundraising. Such donations are for specifically named classes (such as "Marksmanship class" or "Initial CCW Class") with an associated value for that class, but with a date to be specified later.
With reporting and tax requirements in mind, not to mention our own class scheduling, we must place a reasonable expiration date on these kinds of donations. Donated classes involve no purchase price and will simply expire on that date.
Considerations for class purchases with dates specified later
We do not sell gift cards or certificates. We do accept purchases of specifically named classes (such as "your Marksmanship II class" or "your NRA RSO class") with a date to be specified after purchase. We may or may not learn during the purchase that the items so purchased are to be used as gifts.
With reporting and tax requirements in mind, not to mention our own class scheduling, we must place a reasonable expiration date on these kinds of purchases.
Near that date we'll attempt to contact the purchaser to offer a refund. In the (rare) instance that we cannot contact a purchaser or that person's next of kin, we will retain the amount until we next prepare taxes. At that time we will consider the matter closed and will not seek to refund the purchase price.
